Miracle-Ear and its subsidiaries (“we,” “us, or “our”) respect the privacy of our users (“you” or “your”). This Washington Consumer Health Data Privacy Policy supplements our general Privacy Policy and applies to “Consumers” as defined under Washington State’s My Health My Data Act (“WMHMDA”). This privacy policy (“Privacy Policy”) describes Miracle-Ear and its subsidiaries (“we,” “us, or “our”) practices regarding the collection, use, disclosure, transfer, and storage of consumer health data. This Privacy Policy does not supersede, replace, or otherwise amend our general Privacy Policy.

Consumer Health Data We Collect

Some of the products we sell and services that we provide to our customers may result in the collection of data that qualifies as consumer health data (“CHD”). Under WMHMDA, CHD means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status.

We may collect the following categories of CHD and sell/share these categories of CHD with third parties and affiliates, as described below:

  • Book an Appointment. When you request an appointment, you will provide your name, phone number, email address, desired clinic location, and appointment time and date.
  • Find a Clinic. When you search for a location, you will enter your city, zip code, or street address.
  • Online Hearing Test. When you take an online hearing test, you will provide your age range and answers to the test questions.
  • Sending Hearing Test Results. When you send your test results, you will provide your name and email address.
  • Submit Testimonial. When you submit a testimonial, you will provide your name and any other information you choose to provide.
  • Apply for Miracle-Ear Foundation. When you apply for the Gift of Sound, either for yourself or on behalf of someone else, you will provide the applicant type (adult or child), the applicant’s name, applicant’s date of birth, and applicant’s phone number.
  • Unique Personal Identifiers. Device identifier, cookies, beacons, pixel tags, mobile ad identifiers, or other similar technologies, customer number, unique pseudonym or user alias, telephone numbers, or other forms of persistent or probabilistic identifiers that can be used to identify a particular consumer or device.
  • Contact Us. When you contact us, you will provide your name, email address, phone number, your reason for contacting us, and any other information you choose to provide in your message.
  • Other information that may be exchanged in the course of engaging with the Service.  You will be aware of any subsequently collected information because it will come directly from you.

Why We Collect and Use Consumer Health Data

We and our service providers may use the categories of CHD described for the following purposes:

  • To provide information to you about the Service or products;
  • To respond to and process your requests;
  • To distribute communications relevant to your use of the Service, such as system updates or information about your use of the Service;
  • To notify you about changes to this Privacy Notice;
  • To send to you Miracle-Ear solicitations, product announcements, and the like that we feel may be of interest to you (you may “opt out” of receiving these marketing materials);
  • To allow you to participate in surveys or provide testimonials;
  • For safety and security purposes, including:
  •     Detect and respond to threats, to our online operations,
  •     Protect the health and safety of our customers, associates, and the public; and
  •     Prevent, investigate, and prosecute fraud and other criminal activities.
  • To fulfil our legal obligations and enforce rights arising from any contracts between you and Miracle-Ear;
  • To improve how we do business, improve our products and services, and your shopping experience;
  • For other internal business purposes such as:
  •     Quality control
  •     For system administration and technology management, including optimizing our websites and applications
  •     For recordkeeping and auditing purposes
  •     For risk management, investigations, reporting and other legal and compliance reasons
  •     Administer our relationships with our customers
  •     In connection with mergers, acquisitions, divestitures, or similar corporate transactions
  • As otherwise permitted by law or as we may notify you. We may also use CHD you provide to us for other purposes as disclosed at the time you provide your information or otherwise with your consent.
  • To create aggregated or deidentified information. When we create aggregated or deidentified information, we do so in a manner such that it is no longer considered personal information (as defined in WMHMDA). We may use such deidentified or aggregated data to analyze general trends in our business and to provide (or make available) trends and insights to our business clients in aggregated form. 

Sources of Consumer Health Data

As described further in the “What are the sources of personal information collected by Miracle-Ear” section of our Privacy Policy,  we collect information that may be considered to be consumer health data directly from you, when you visit our online store, your interactions with our websites, third party social networking services, publicly accessible sources, Miracle-Ear subsidiaries or affiliates, or third-party service providers and other partners. 

Third Parties and Affiliates with Whom We Sale/Share Consumer Health Data

As defined by WMHMDA, we sell and share consumer health data with the categories of third parties and the affiliates listed below. When we sell or share consumer health data, we sell or share it in accordance with the WMHDMA.

  • Franchisees. We may share consumer health data with independent Miracle-Ear franchisees to provide healthcare services.
  • Third Parties Pursuant to Marketing. We may share CHD to help us improve our products and services, and your shopping experience through data brokers, advertising networks, and data analytics providers.  
  • Competent Governmental and Public Authorities. We may share CHD with governmental authorities if we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity or a violation of our Terms and Conditions or other contracts.
  • Third Parties Pursuant to Legal Process. We may share CHD to the extent necessary to respond to subpoenas, court orders, or other legal process; in response to a request for cooperation from law enforcement or a government agency; or to otherwise comply with our other legal and regulatory obligations.
  • Other Third Parties. We may share CHD when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, including to allow us to pursue available remedies and limit the damage we may sustain.
  • Notwithstanding anything else in this notice, we may share data that has been aggregated or deidentified in such a manner that it is no longer considered personal information (as defined in the WMHMDA). When we share aggregated or de-identified data, we require recipients to refrain from reidentifying the data and to pass this obligation on to downstream recipients.

Exercising Your Privacy Rights & Authorizing Agents

WMHMDA provides covered individuals with certain rights to access, delete, and, to the extent applicable, withdraw consent relating to their consumer health data, subject to certain exceptions.

Only you, or a person authorized by you to act on your behalf, may make a verifiable consumer request related to your CHD. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected CHD or an authorized representative and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will verify your identity either to a “reasonable degree of certainty” or a “reasonably high degree of certainty” depending on the sensitivity of the CHD and the risk of harm to you by unauthorized disclosure, deletion, or correction as applicable. To do so, we will ask you to verify data points based on information we have in our records concerning you.

If your request to exercise a right under the WMHMDA is denied, you may appeal that decision by following the instructions that we provide when we deny your request. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

Revisions To This Privacy Policy

Miracle-Ear reserves the right to modify this Privacy Notice from time to time to ensure that it accurately reflects the regulatory environment and our data collection principles. When material changes are made to this Privacy Notice, Miracle-Ear will post the revised Privacy Notice on our website. Your continued use of our websites after any update to this notice will constitute your acceptance of our changes.
